Nord Kivu : Le professeur Docteur Justin HAGUMA parle du bilan 2020 négatif suite au dossier opposant la SOMICO à la SAKIMA

Au cours d’une interview à bâton rompue accordée au magazine La Ponctualité au sujet de l’avancement des activités au sein de la SOMICO, le Directeur de cette entreprise publique, le professeur docteur Justin HAGUMA fait savoir que cette organisation de l’État  congolais a passé une période  de vache maigre  liée au procès opposant la SOMICO contre la SAKIMA  au tribunal de grande instance de Goma. Docteur Justin HAGUMA affirme que son entreprise dispose  tous les documents permettant à celle-ci de fonctionner légalement et qu’il s’agit tout simplement d’une récupération politicienne pour certains politiciens qui veulent renfler leurs poches au détriment de la population. Il sollicite cependant l’implication des autorités tant nationales que provinciales pour que cette épineuse question cesse d’être un bras de fer entre acteurs politiques véreux mais trouve une solution durable pour l’intérêt de la communauté

«Vraiment je peux dire que le bilan est négatif  d’autant plus qu’on n’a pas travaillé, on a eu assez des blocages au niveau de la justice.  Nous sommes en train de comparaitre alors cela nous a empêché même de travailler, même les investisseurs sont arrivés, ils n’ont pas apprécié, ils voulaient qu’on puisse finir avec la justice je peux oser dire qu’on n’a pas  vraiment  travaillé, tout cela parce il y a eu des blocages par rapport aux démarches et par rapport aux initiatives de la société, mais espérons que tout ira bien avec l’année 2021, »a précisé professeur docteur Justin HAGUMA.

Pour ceux-là qui accusent la SOMICO de fonctionner illégalement, cette élite intellectuelle rétorque qu’ils se trompent, l’entreprise dispose des documents lui permettant de bien mener ses activités.

«Je pense que ceux qui disent que nous travaillons illégalement ont tort parce que la société a bel et bien des documents, nous avons le récépissé, le statut harmonisé,  le journal officiel, le décret présidentiel, des lettres des ministres nous autorisant à fonctionner, donc on a toute la documentation possible mais nous n’avons pas accès aux concessions et cela le problème.  Nous avons  toute la documentation susceptible d’avoir une société au Congo. Mais nous avons des difficultés d’accéder dans les concessions puisque elles sont occupées par d’autres sociétés qui sont illégales, » a expliqué Justin HAGUMA. Et de poursuivre que la SOMICO est en franche collaboration avec les autorités du pays :

«Vraiment nous sommes en communication avec le ministre de portefeuille, avec la Présidence de la République. Nous sommes en communication avec les autorités de   Kinshasa, néanmoins il y a eu une cacophonie qui a été délibérément créée par les politiciens  entre la SOMICO et la SAKIMA, ce qui est un problème. Il fallait que l’État puisse se prononcer quant à la SOMICO ou à la SAKIMA,  parce que la SOMICO c’est l’ex SOMINKI et c’est la SOMICO qui  est devenu SAKIMA. Et la SOMICO dit que SAKIMA utilise les faux documents et ils sont à la justice. Certains  politiciens soutiennent la SOMICO, d’autres  la SAKIMA. Il fallait que les autorités se mettent ensemble avoir un compromis quant à ces deux sociétés pour que le problème soit élagué une fois pour toute dit docteur Justin HAGUMA.

À la question de savoir qui a gagné le procès entre la SAKIMA et la SOMICO, le professeur docteur Justin HAGUMA a fait savoir que  l’état congolais est entrain de suivre de près ce dossier parce que le tribunal de grand instance de Goma a même pris des décisions de mettre sous séquestre tous les biens de la SAKIMA, voir même de la SMB et l’appel a été interjeté au niveau de la cour d’appel tout en demandant qu’on rentre sur le fond du dossier ,la SOMICO a même reçu la correspondance ou la décision du conseil d’état reconnaissant les concessions appartiennent à la SOMICO :

«Nous sommes allés au tribunal de grande instance qui a pris des décisions de mettre sous séquestre tous les biens de la SAKIMA, voir même la SMB et à présent on a interjeté appel, et au niveau du cour d’appel on a demandé que nous puissions rentrer sur le fond, savoir légalement qui est de droit parmi ces deux société. Mais aussi nous avons déjà reçu la correspondance ou la décision du conseil d’état, qui reconnaît que les concessions appartiennent à la SOMICO. Chose étonnante, nous avons reçu la nomination d’un liquidateur après vingt ans, ce qui veut dire que s’il y a un liquidateur, ça veut dire que la SAKIMA n’existe pas, parce qu’ il faut qu’on liquide pour créer une société.

Alors on a créé la Société avant la liquidation, tu comprends que la politique joue un mauvais rôle dans cette situation. Mais l’essentiel est que pour moi, ni la SAKIMA mon point de vue nous travaillons pour l’Etat et la SAKIMA et la SOMICO, il fallait que la politique se mette ensemble qu’on voit ensemble si on a des investisseurs, s’ils travaillent avec la SOMICO ? Ils vont mettre dans la caisse de l’Etat, s ils travaillent avec la SAKIMA, ils vont également mettre dans la caisse de l’état, » a expliqué Justin HAGUMA.

Pour Justin HAGUMA,  la justice devra chercher des solutions idoines à cette épineuse question pour l’intérêt communautaire car plusieurs concessions demeurent inexploitées et pourtant elles doivent également contribuer au développement de la province du Nord-Kivu en particulier et de la RDC en général :

« Par exemple aujourd’hui la SAKIMA occupe le territoire de MASISI et WALIKALE, mais BENI, LUBERO ne sont  pas occupées par la SAKIMA et pourtant  il y a des concessions de l’ex SOMINKI qui arrivent à BENI et à LUBERO. Que le gouverneur s’implique, qu’au niveau national on s’implique et cesse de travailler pour le ventre parce il y a un manque à gagner. Pendant tout ce temps, les minerais ne sont pas  produits parce qu’il y a une cacophonie,  il y a des gens  qui gagnent régulièrement sans se soucier de la population.  C’est pourquoi même jusqu’aujourd’hui la SAKIMA n’a jamais produit, n’a  jamais été une société parce qu‘ils travaillent pour leur compte, ils vivent le présent et cela crée un problème a-t-il martelé.

Le professeur Justin HAGUMA lance un message aux autorités de la RDC,  leur demandant de travailler main dans la main et mettre de côté des intérêts égoïstes, savoir surtout que la province du Nord-Kivu a d’autres concessions dans le domaine de l’agriculture  il n y a pas que les minerais et cela aussi attire les investisseurs.

Tout en prêchant les valeurs morales  aux autorités congolaises Il finit par remercier le Président de le République qui jours et nuits ne cesse de travailler pour le bienêtre du peuple congolais avant d’annoncer l’arrivée prochaine des investisseurs à la SOMICO  qui vont intervenir dans le domaine agro pastoral dans le BENI et LUBERO.
